Kick 2 terms of use for commercial samples/presets packs

Hi there,

am I allowed to make my own kick-sounds in Kick2 and sell them in a construction kit-pack (for other producers to use)?
With our without using the factory samples…

There’s a common sense & golden rule when it comes to any soft synth and making commercial samples or presets with them : the sound designer must start with the INIT preset to create his own sounds with the software unless the software manufacturer grants you a written permission to use & modify their original factory or banks presets, then this rule always applies. With Kick 2 it also means that you must create & use your own original “Clicks Sounds”.

When you install the software, there’s a Software License Agreement that the end user should read and accept. If you check paragraph 3 of section III. Sonic Academy SOUND LICENSE AGREEMENT you’ll find all the details about using the manufacturer’s content. In a nutshell you’re granted with a single end user license and the right to use those samples & presets inside commercial or non commercial music, but not modifying nor repacking or distributing those samples & presets in any other sound libraries, sample based libraries, virtual instruments or audio loops.

Next to that, using existing factory or banks presets to start your sound design could lead to issues with customers claiming that your work isn’t original and that they payed for a modified preset or sample based on other’s work and that’s never a good thing if you want to make & keep a good reputation as a sound designer.

Follow the simple & safe rule : any sound design must start with the INIT preset and use your own original click sounds.

I have started making basic sounds in Logic Drum Synth, recording sounds with a microphone and cutting some old drum recordings to import to Kick2…it is actually great fun!
