Sampling and the law

I have made an instrumental track and found a vocal that fits nicely in it. This vocal is from the Defected Acapellas range of vinyl - where do you stand legally on this???

if you approach the label and they agree to you using it (for a cut) it can be worth while using acapellas.



If you do it and get caught the take all the money you made from the track.

youd be surprise how many of the big track by big artists use samples



basement jaxx and daft punk nearly always use a sample.

the law on sampling is not well settled in the UK. Most labels think that they have the right to control each and every sound that they have recorded. That's not the case. Under UK law the piece copied has to be a "substantial reproduction" of the work in tota, this means either you have taken a big chunk or you have taken a recogniseable part (objectively recogniseable - i.e. to the general public not the original producer). The other way to infringe is that you have received a "leg up" by copying, i.e. gotten something you would never have been able to get yourself.

Rule of thumb is that if you think an average someone would hear what you've taken and realise that it had come from the original source, then you need to get permission.
